1. Agreement and guest use
You do not need an account to use features offered to guests. When we present these Terms with an “I agree” control or another action clearly identified as acceptance, taking that action signifies your agreement. These Terms apply to use following legally effective acceptance, whether or not you sign in. If you do not agree, do not take that acceptance action or continue with the features requiring it.
Merely making these Terms available does not eliminate any notice or acceptance requirement imposed by law. Laws protecting privacy, intellectual property, and computer systems may apply independently of a contract.
2. Eligibility and accounts
The Services are intended for people who are at least 18, have reached the age of majority where they live, and can enter a binding agreement. If you act for an organization, you must have authority to bind it.
Provide accurate account information, safeguard credentials, and promptly report suspected compromise to support@binaby.com. Do not impersonate another person or sell or transfer access without permission. You are responsible for your conduct and authorized account use; this does not excuse our own legal responsibilities. Some features, including a private saved-products shortlist, require an account.
3. Shopping intelligence and third-party transactions
Binaby helps users find and compare listings from participating sources. We are not the seller of the products shown and do not process product purchases, fulfill orders, or administer the seller’s shipping, returns, or warranties. Purchases take place with the relevant merchant or marketplace under its terms.
Our results do not include every seller or offer. Source availability, location, search terms, filtering, and data quality can affect what appears. Prices may omit shipping, taxes, fees, membership requirements, or variant-specific costs. Confirm the product, seller, condition, compatibility, final price, availability, and purchase terms at the destination before buying. Nothing here excludes liability that law places on Binaby for its own conduct.
4. Extracted attributes, comparisons, and recommendations
We use automated methods to interpret product titles and source data, generate filters, group listings, and estimate price ranges and attributes associated with price. Extracted attributes, matches, recommendations, and summaries can be incomplete or wrong. Similar listings may differ in pack count, condition, accessories, compatibility, or specifications.
A typical price or range describes the analyzed results, not every transaction in the market. An attribute associated with price is not proof that it causes a price difference. A recommendation is a shopping aid, not product testing, a safety certification, a seller guarantee, or a promise of quality, savings, suitability, or the lowest price. Independently verify information important to your decision, especially health, safety, and compatibility claims.
Homepage promotional images are AI-generated illustrations, not photographs documenting product testing or actual offers. Illustrative demonstrations are examples rather than live offers. Cached, saved, or shared listing snapshots may be older than the date they are displayed or shared. Automated analysis does not provide professional advice.
5. Saving and sharing
Saving a product records a reference or snapshot; it does not reserve stock, lock a price, place an order, or create a price-alert service. Your account’s shortlist is not a public profile.
A listing link created by our save/share functionality refers to a separate public product snapshot. Anyone with that link may view or forward it. Removing an item from your shortlist does not necessarily delete the public snapshot or copies held by others. The public listing page is separate from the private record that you saved it. 6. Limited permission to use the Services
Subject to these Terms and applicable law, we permit you to use our official interfaces for your own shopping research and to share links using available features. Any mobile-app license is nonexclusive, nontransferable except as allowed by applicable store terms, and limited to devices you own or control. This permission does not grant bulk data, resale, sublicensing, or independent API-integration rights.
Assistive technology and ordinary browser functionality supporting permitted use are allowed. Automated access expressly authorized by us is allowed only within its stated scope and limits. Mandatory rights under applicable law are preserved.
7. API access, automation, and security restrictions
Requests made by our official website and apps as part of normal permitted use are authorized. An endpoint’s visibility in a browser, a mobile application, or network traffic does not itself grant permission to build another client, redistribute a feed, or access protected resources. Independent API integrations, bulk extraction, commercial data reuse, and automated collection require our express written authorization or an applicable published API license.
You must not:
- access another person’s account, private shortlist, administrative tools, or restricted data without authorization;
- steal, disclose, forge, or misuse credentials, tokens, signing keys, or identifiers;
- bypass authentication, authorization checks, quotas, rate limits, or other access restrictions, including by rotating accounts, devices, or proxies;
- conduct disruptive load tests, introduce malicious code, interfere with availability, manipulate analytics or recommendations, or exploit a vulnerability to extract or alter data;
- systematically scrape, mirror, republish, sell, or use our protected content or data feeds to train models without permission, except where applicable law permits the activity;
- reverse engineer or circumvent protections except where applicable law permits it notwithstanding this restriction; or
- continue restricted access after permission has been revoked.
Search indexing expressly permitted by us is limited to public pages and applicable crawler instructions; it does not authorize private-data access, reuse beyond that permission, or bypassing controls. For integration permission, contact support@binaby.com.
Suspected vulnerabilities may be reported privately to support@binaby.com. Stop testing if you encounter someone else’s data; do not copy, alter, disclose, or retain it beyond what is lawfully necessary to report the issue safely. Request written scope before active testing. These Terms do not create a bounty or an unrestricted testing authorization, and do not override legal protections for lawful research.
8. Intellectual property and third-party material
Binaby or its licensors own the rights they hold in our software, original designs, branding, and protectable compilations and analysis. Retailer photographs, descriptions, trademarks, and other third-party material remain subject to their owners’ rights. We do not claim ownership of public facts merely because they appear in our results.
Except for permitted use or rights provided by law, do not copy, distribute, modify, commercialize, or remove proprietary notices from protected material without the relevant owner’s permission. Our share features do not grant a license to republish a retailer’s images or content independently. Report suspected infringement with the affected URL, identification of the work or right, your contact information, and the basis of your complaint to support@binaby.com.
9. Affiliate relationships and sponsored placements
Some outbound links can generate a commission or referral fee for Binaby. Our Affiliate Disclosure explains these relationships. Any paid placement or sponsored recommendation must be identified where it appears. A monetized link is not a guarantee about a product or seller.
10. Information you provide and privacy
You retain your rights in original material you submit. You grant us only the nonexclusive rights reasonably needed to host, process, and display that material to provide the feature you choose, subject to your privacy settings and applicable law. Sharing an item publicly authorizes display of what you intentionally share, not publication of your private shortlist or support messages.
You must have the necessary rights to material you provide and must not submit unlawful, infringing, or abusive material. We may remove material or restrict features for violations or legal and security reasons. General product suggestions may be used to improve the Services without payment, but personal information remains subject to the Privacy Policy. These Terms do not make private communications public or override privacy rights. New social features may require additional notices and rules.
11. Changes, restrictions, and termination
We may change or discontinue features, impose reasonable usage limits, and restrict access where reasonably necessary for security, abuse prevention, legal compliance, or violations. Where appropriate and legally required, we will provide notice and a way to contact us about a restriction; urgent action may be taken without advance notice.
Material Terms changes will receive reasonable notice appropriate to their significance, and renewed acceptance where required. We will identify the effective date. Changes will not retroactively alter an existing dispute without a legally valid agreement. You may stop using the Services and request account deletion. Deletion and lawful retention are addressed in the Privacy Policy.
12. Warranty disclaimer
TO THE EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not promise uninterrupted access or error-free product information. This disclaimer does not exclude mandatory warranties, express commitments that cannot lawfully be disclaimed, or consumer rights that cannot be waived.
13. Limitations of liability
TO THE EXTENT PERMITTED BY LAW, Binaby is not liable for indirect, consequential, incidental, special, or punitive damages, or lost profits, arising from the Services or third-party transactions. Subject to the exceptions below, Binaby’s aggregate liability arising from the Services is limited to the greater of US $100 or amounts you paid Binaby for the Services during the 12 months before the event giving rise to the claim.
These exclusions and the cap do not apply to fraud, willful misconduct, gross negligence where it cannot lawfully be limited, or any other liability or statutory remedy that applicable law does not allow us to exclude or limit. Mandatory consumer protections take priority.
14. Responsibility for unlawful conduct and enforcement
To the extent permitted by law, you are responsible for losses caused by your unlawful conduct or material breach. You agree to indemnify Binaby against third-party claims and reasonable related costs to the extent caused by your intentional unlawful misuse, infringement of another person’s rights, or knowing material breach of these Terms. This does not cover claims caused by Binaby’s own fault or impose obligations prohibited by consumer law.
We will give prompt notice of an indemnified claim, allow reasonable participation in its defense, and will not settle in a way that admits fault or imposes nonmonetary obligations on you without your consent. We may preserve relevant evidence, block abusive access, and seek damages or injunctive relief where legally available. These Terms do not declare conduct criminal or create automatic penalties; statutory remedies depend on the facts and applicable law.
15. Disputes and applicable law
Please contact support@binaby.com with a description of a concern so we can try to resolve it. This informal process does not prevent either party from bringing a timely claim, seeking urgent relief, or contacting a regulator.
California law governs these Terms, excluding conflict-of-laws rules, except to the extent mandatory law requires otherwise. Subject to mandatory consumer venue rights, disputes may be brought in courts with jurisdiction in San Diego County, California. Nothing here prevents a consumer from invoking nonwaivable protections or bringing a claim in another forum where applicable law gives that right.
These Terms do not require mandatory arbitration or waive rights to a jury trial or participation in a class action. Any later change requires legally effective notice and acceptance.
16. Mobile stores and mandatory rights
Your use of an app downloaded through a store is also subject to applicable store terms. Nothing here reduces rights under the applicable store license or mandatory law. Binaby is responsible for its Services; Apple and other distribution platforms do not become sellers of the products shown in Binaby. Contact Binaby for app support at support@binaby.com.
17. General provisions and contact
If a provision is unenforceable, the remaining provisions continue to the extent permitted by law. Not enforcing a provision immediately does not waive it. Neither party may transfer obligations to avoid the other’s legal rights. We may transfer this agreement with a business reorganization or sale, subject to applicable notice and privacy obligations. These Terms and any expressly agreed feature-specific terms govern the relevant Services; the Privacy Policy explains personal-information practices and is not overridden by these Terms.
